Staying Safe for the Holidays

Enjoying the Holidays


Everyone loves the holiday season - at least I know I do! It's my favorite time of the year.  Decorations are up earlier than expected this year, seasonal music will soon start filling the airwaves, the temperature starts to cool down, and the tree goes up with presents slowly filling the space beneath it. 

As home owners and tenants, it's important to remember though, that safety, though not always on the top of our mind during this season, is important so we don't interrupt the wonderful cheer. 

Things to think about:

  • Thanksgiving Dinner - Keep an eye on the stove/oven - especially if you're doing some frying.  The worst way to end your Thanksgiving feast is with a house fire. 
  • Outlets - with Christmas decorations and lights going up, be sure you aren't overloading the outlets - a sure sign is if your lights all go out - reset the breaker and re-think how you're setting them up.  
  • Christmas Tree - If you are putting up a real tree, though beautiful and frangrant, these are highly flamable, so be sure not to leave lights on overnight, and to keep it away from a heat source.  If your tree catches fire, you can bet it will get the rest of your house.
  • Christmas Wrapping - often times we do our Christmas wrapping out on the floor of the living room, or on our desk and leave supplies out.  Just a reminder that especially if you have children, be careful of leaving items such as scissors out in an easily reachable area.

New law will allow collection of Pet Deposits

Senate Bill 328

In July, Governor Neil Abercrombie signed a bill that will allow for landlords to collect a separate Pet Deposit in addition to the standard security deposit for all leases starting November 1, 2013 or later. 

In the past, landlords were only allowed to collect a Security Deposit up to the amount of one month's rent and no more - any additional deposits were illegal to collect. 

In this new law, it will allow landlords to collect a deposit for a pet for any damages they may cause with the following guidelines:

  • "Pets Only" - you may NOT collect a "Pet Deposit" for assistance animals that are assigned to people with a dissability.
  • Limit - the Pet Deposit cannot exceed the amount of one month's rent.
  • Start Date - only affects leases starting on or after November 1, 2013.
  • Refund - if there are no damages to the property from the pet, the deposit must be returned in full to the tenant - similar to how you would treat a Security Deposit.
This will hopefully give an incentive to home owners to allow pets more often for their rentals, knowing that a Pet Deposit will encourage pet owners to be responsible.

New Standard Rental Agreement for Oahu

Hawaii Association of Realtors Standard Form Revised

This May, the Hawaii Association of Realtors revised the standard Rental Agreement form to include some changes in formatting, but also a change in terms for the Military Clause.  

Previously, if someone in the Military received orders to PCS (permanent change of station), they needed to provide a written notice, copy of the orders, and 28 days notice.  

The new rule states they still need to provide written notice (verbal notice will not be sufficient), a copy of the orders, and they will now be responsible for the remainder of the month in which they give notice, and also the entire following month. 

Please look over the new form to become familiarized with the changes.
